By accessing or using MarcMyCar's automated dealership image branding service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you or the entity you represent ("you", "your", "Customer") and MarcMyCar ("we", "us", "our", "Company").
MarcMyCar provides an automated image branding service that enables automotive dealerships to:
The Service is provided via subscription plans with monthly or annual billing cycles.
Eligibility: You must be at least 18 years old and authorized to enter into contracts to use this Service. By registering, you represent that you have the authority to bind the dealership or organization you represent.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
We offer multiple subscription tiers (Starter, Accelerator, Professional) with varying vehicle limits and features. Current pricing is displayed on our website and may be updated with 30 days' notice.
All subscription fees are non-refundable except where required by law. We do not provide prorated refunds for mid-cycle cancellations.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Access to the Service will continue until that date.
No Contracts: We do not require long-term contracts. You can cancel anytime without penalty.

We reserve the right to suspend or terminate accounts that violate these terms.
You retain all ownership rights to images you upload. By uploading, you grant us a limited license to process, store, and deliver images as part of the Service.
All intellectual property in the Service itself (software, algorithms, interface design, branding) remains the exclusive property of MarcMyCar. You may not copy, modify, or create derivative works.
Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Image Retention:
Uptime: We strive for 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where possible.
Service Changes: We may modify features, pricing, or discontinue the Service with 30 days' notice. Material changes affecting existing customers will be communicated via email.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
This limitation applies to the fullest extent permitted under UK law.
You agree to indemnify and hold MarcMyCar harmless from any claims, damages, or expenses (including legal fees) arising from:
While we check images against AutoTrader, CarGurus, and other platform guidelines, we do not guarantee acceptance by these platforms. You are responsible for ensuring your listings comply with each platform's current policies.
We may suspend or terminate your account if you:
Upon termination, your access will cease immediately, and we will delete your data per our retention policy.
Jurisdiction: These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Informal Resolution: Before initiating legal proceedings, please contact us at support@marcmycar.com to attempt resolution.
We may update these Terms from time to time. Material changes will be notified via email or in-app notice 30 days before taking effect. Continued use after changes constitutes acceptance.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MarcMyCar and supersede any prior agreements.
